Question

Why isn't super calculated on unused annual leave when terminating an employee?

Answer

The Superannuation Guarantee Act, administered by the ATO, does not require employers to apply to 11% superannuation calculation on unused leave paid on termination. See ATO document NAT 2125-12.2000.
